1. Introduction
At Brand Awareness Research (also referred to in this policy as ‘BAR’, ‘we’, ‘our’ or ‘us’), we care about the privacy of your data and are committed to protecting it. This Privacy Policy explains what information we collect about you and why, what we do with that information, and how we handle that information.
This notice applies across all websites that we own and operate including brandawaresurvey.com and all services we provide, including our surveys, online platform and any other services we may offer. For the purpose of this policy, we’ll just call them our ‘services’. This policy applies to all Brand Awareness Research products and subsidiaries in all markets and territories.
When we use the phrase “data” in this Privacy Policy we mean whatever data submitted or which we have on a site or an app hosted by us, or the data you collect via our services, whether that’s survey responses, data collected in a form.
When we use the phrase “personal information”, we mean identifiable information about you, like your name, email, address, telephone number, and so on, that we collect or for which we are a custodian. If you can’t be identified (for example, when personal data has been aggregated and/or anonymised) then this notice doesn’t apply.
2. The information we collect about you and how we collect it
This depends on who you are:
Customers
You hold a BAR account and you either directly create surveys, forms, applications, or questionnaires or you are collaborating on, commenting on, or reviewing surveys, forms, applications, or questionnaires within an account.
Respondents
You have received a survey, form, application, or questionnaire from BAR and completed and submitted this.
Visitors
You visit one of our websites (e.g, brandawaresurvey.com).
If you are a Customer, Respondent or Visitor, this is the sort of information we may collect about you:
Information you provide to us directly: When you visit or use some parts of our websites and/or services we might ask you to provide personal information to us. You might provide us with your contact information (for example an email address), whether through use of our services, a form on our website, interaction with our sales or customer support team, or a response to one of our own surveys.
If you don’t want to provide us with personal data, you don’t have to, but it might mean you can’t use some parts of our websites or services.
If you are an Customer we will also collect Account Information including:
- Registration information: You need an account before you can use our services. So when you register for an account, we collect information about yourself and your organisation including personal information like your first and last name, username, password and email address.
- Billing information: If you make a payment to us, we require you to provide your billing details including a name, address, email address and financial information corresponding to the method of payment (e.g. a credit card number and expiration date or a bank account number). If you provide a billing address, we will regard that as the location of the account holder.
- Account settings: you can set various preferences and personal details through the ‘account settings’ for things like your default language, time zone and communication preferences (e.g. opting in or out of receiving marketing communications from us).
- Use of some of our services will also result in us collecting the following data on your behalf:
- Uploaded participant information: we may allow you to import email addresses and other contact information into a database so you can easily invite people to participate in your surveys. We don’t use this data for our own purposes or contact anyone, except at your direction.
- Survey/form/application data: we store this data (questions and responses) for you and provide analytical tools for you to use with respect to this data.
- Profile information: when you sign up for our services you are asked to provide us with information about yourself and your organisation.
Information we collect automatically: We collect some information about you automatically when you are a Visitor to our websites or a Customer using our services, like your IP address and device type. We collect usage information about you whenever you interact with our websites and services. This includes which web pages you visit, what you click on, when you perform those actions, and so on. This information is useful for us as it helps us get a better understanding of how you’re using our websites and services so that we can continue to provide the best experience possible (e.g., by personalising the content you see).
Some of this information is collected using cookies and similar tracking technologies.
Information we get from third parties: We use first party and third party tracking services that employ cookies and page tags to collect data about visitors to our websites. This data includes usage and user statistics. Emails sent by BAR or by users through our services also include page tags that allow the sender to collect information about who opened those emails and clicked on links in them. You can choose to remove or disable cookies via your browser settings.
We use this information to supplement the personal information we already hold about you, in order to better inform, personalise and improve our services, and to validate the personal data you provide. We collect your personal information from third parties where, for example, you give permission to those third parties to share your information with us or where you have made that information publicly available online.
Prize Draw information: If we are paying you to be a Respondent to one of our surveys or if you have been entered into one of our draws, we may also ask you for some financial details so we can make payment to you. These might include information corresponding to your selected method of receiving payment (e.g. a credit card number or a bank account number).
3. How we use this information:
Using Customer information:
If you are a Customer we process personal information about you and information about your organisation so that we can:
- Fulfil our contractual responsibility to deliver services to you;
- Help us to improve our service experience and develop new products and services.
As a Customer you have consented to us using certain types of tracking and third party cookies on our websites. We may use cookies to tailor ads to users, to enable us to determine the success of our advertising campaigns and to improve upon them. These third party data and advertising platforms may sometimes use data that we provide to them in order to improve their technologies and their ability to match common devices to users. We also may also use this technology to allow a Customer to measure the performance of their survey campaigns and to learn how to improve survey completion rates.
Your Account Information. We need to use your account information to run your account, provide you with services, bill you for our services, provide you with customer support, and contact you about your service or account. We occasionally send you communications of a transactional nature (e.g. service or billing-related notices, changes to our services or policies, a welcome email when you first register). You cannot opt out of these communications since they are required to provide our services to you.
You can object to us using your information as described above but in some cases, our ability to fully and properly provide our services to you may be impacted if you do not want us to collect or use the above data.
In relation to survey data we also use survey questions and responses on an aggregated and anonymized basis as described in this Privacy Policy. We will never sell individual response data or identify / contact individual respondents except where required by law.
Contact Information: we use contact information to respond to your inquiries, send you information as part of the services, and send you marketing information (for as long as you do not opt-out).
How you use our services: We use information about how Customers use our services to improve our services for you and all users.
Device and browser data: We use device data both to troubleshoot problems with our service and to make improvements to it. We also infer your geographic location based on your IP address. We also collect these to help us improve your service experience through a specific device/browser by optimizing how the website looks in a particular browser and to ensure the service operates optimally and as it should on different devices and browsers.
To manage our services we will also internally use your information and data, for the following limited purposes:
- To enforce our agreements where applicable.
- To prevent potentially illegal activities.
Legal uses: to respond to legal requests or prevent fraud, we may need to use and disclose information or data we hold about you. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
Using Respondent information:
We use information about how Respondents use our services to improve our services for all users.
Cookies and page tags: We collect information using cookies when you take a survey. These cookies are used to ensure that the full functionality of our survey service is operational, and to ensure the survey operates appropriately and optimally. After completion of a survey, in most cases, you will be redirected to our website and treated as a website visitor where other cookies may be used so you should read our information about Visitors if this is of interest to you. You can choose to remove or disable cookies via your browser settings.
Contact Information: We only use contact information to respond to an inquiry which you, as a Respondent, submit to us.
Device and browser data: We use device data both to troubleshoot problems with our service and to make improvements to it. We also infer your geographic location based on your IP log data.
Third parties and integrations: We will collect and use information from third parties and integration partners to facilitate Customers in sending surveys/forms/applications/questionnaires to you.
Machine learning: We will use machine learning techniques on response data and cookie data, in order to provide Customers with useful and relevant insights from the data they have collected using our services, to build features, improve our services, for fraud detection and to develop aggregated data products. You can read more about this in relation to surveys below.
To manage our services we will also internally use your information and data, for the following limited purposes:

Legal uses: To respond to legal requests or prevent fraud, we may need to disclose any information or data we hold about you. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
Use of survey responses: In general, the responses to our surveys are controlled and managed by the Customer (the person who sent or deployed that survey). In those instances BAR is only processing those responses on behalf of the Customer.
Customer and Respondent trust is critical to everything we do and so when we do use data about Respondents, we put Customers and Respondents first. When we do analysis of response data we only do so once we have ensured the anonymity of individual respondents (by aggregating and anonymizing the data). Our goal is to improve the user experience across our survey services while maintaining the confidentiality and privacy of responses.
A Customer has some controls over how we use responses in their Account settings and may have turned off our ability to apply machine learning to responses where it is a feature.
BAR will use automated processes and machine learning, to analyze survey responses, which in turn helps us to aggregate responses, activity and behaviour of Respondents so that we can identify trends, build product features that optimize responses, make product recommendations and provide guidance on which products and services work best in different scenarios. These product features also provide feedback and recommendations to increase response rates.
By understanding response data and Respondent interaction in different types of surveys we can improve our services and ease of use: for example, we might identify when respondents prefer multiple choice versus open text questions and make predictive response suggestions when certain question types are selected. We might also use this data to:
- help improve analysis of responses,
- improve user experience, and
- identify insightful data trends (which never identify any individuals).
Using Visitor information:
If you are a Visitor we process personal information about you where you have consented or, in BAR’s legitimate interests of:
- improving service experience; and
- developing new products and service features.
Contact Information: we use contact information to respond to your inquiries, send you information as part of the services, and send you marketing information (as long as you have agreed to this at the point of providing your information and for as long as you do not opt-out).
Cookies and similar technology: we or third party data and advertising platforms that we work with may use or combine multiple technologies, such as cookies, page tags, mobile identifiers and IP addresses to infer users’ common identities across different services and multiple devices such as tablets, browsers, and mobile phones. We may do so, for instance, to tailor ads to users, to enable us to determine the success of our advertising campaigns and to improve upon them.
Device data: We use device data both to troubleshoot problems with our service and to make improvements to it. We also infer your geographic location based on your IP address.
How you use our services: We use information about how you have interacted with our websites to improve our website services for you and all users.
Legal uses: To respond to legal requests or prevent fraud, we may need to disclose any information or data we hold about you. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
4. Information you share
Many of our services let you share information with others. Remember that when you share information publicly, it can be indexable by search engines. Our services provide you with different options on sharing and deleting your content but we cannot delete content from search engines so you need to be careful about information you make public.
5. Information we share:
If you are a Customer that is part of a team plan, your account information and data will be shared with the primary administrator(s) and your survey data may also be visible to other members in your team with whom you share your surveys or with whom you collaborate. Your administrator(s) will be able to view your account data, change your passwords, suspend, transfer or terminate your account or restrict your settings. Please refer to your organization’s internal policies if you have questions about this.
To help us provide certain aspects of our services we use our affiliates and trusted key partners to:
- facilitate email collection for sending surveys by email to Respondents.
- facilitate Customers in making credit card payments.
- deliver and help us track our marketing and advertising content.
- help us track website conversion success metrics.
- manage our sales and customer support services to you.
We enter into confidentiality and data processing terms with partners to ensure they comply with high levels of confidentiality and best practice in privacy and security standards and we regularly review these standards and practices.
On your instructions, we share your information or data if you choose to use an integration in conjunction with our services, to the extent necessary to facilitate that use. We also may have to share information or data in order to:
- meet any applicable law, regulation, legal process or enforceable governmental request.
- enforce applicable policies, including investigation of potential violations.
- detect, prevent, or otherwise address fraud, security or technical issues.
- protect against harm to the rights, property or safety of our users, the public or to us and/or as required or permitted by law.
- facilitate a sale, merger or change in control of all or any part of our company or business or in preparation for any of these events.
6. Security
Security Policies
We maintain and regularly review and update information security policies.
Information Security Incident Management
BAR maintains security incident response policies and procedures covering the initial response, investigation, customer notification (no less than as required by applicable law), public communication, and remediation. These policies are reviewed and tested regularly.
Breach Notification
Despite best efforts, no method of transmission over the Internet and no method of electronic storage is perfectly secure. We cannot guarantee absolute security. However, if BAR learns of a security breach, we will notify affected users so that they can take appropriate protective steps. We are committed to keeping our customers fully informed of any matters relevant to the security of their account and to providing customers all information necessary for them to meet their own regulatory reporting obligations.
Your Responsibilities
Keeping your data secure also requires that you maintain the security of your account by using sufficiently complicated passwords and storing them safely. You should also ensure that you have sufficient security on your own systems.
7. Data Retention
If you hold an account with us we do not delete the data in your account. There are controls in your account where you can delete data at the account level (all data in your account) and at the response level.
8. Safety of Minors
Our services are not intended for and may not be used by minors. “Minors” are individuals under the age of 13 (or under a higher age if permitted by the laws of their residence). BAR does not knowingly collect personal data from Minors or allow them to register. If it comes to our attention that we have collected personal data from a Minor, we may delete this information without notice. If you have reason to believe that this has occurred, please contact our customer support.
9. Changes to our Privacy Policy
We can make changes to this Privacy Policy from time to time. We will identify the changes we have made on this page. In circumstances where a change will materially impact the way in which we collect or use your personal information or data, we will send a notice of this change to all of our account holders.
10. Personalized marketing
You can opt-out from direct marketing in your account and we provide opt-out options in all direct marketing emails. If you do not wish to see personalized marketing content on the web related to our service you can clear the cookies in your browser settings.
11. Who is my data controller?
As mentioned above, all response data at an individual level is controlled by the Customer. BAR can be a data controller of data about Respondents only in very limited ways.
12. Your rights
Some of you (in particular, EU users) have certain legal rights to obtain information about whether we hold personal information about you, to access personal information we hold about you, and to obtain its correction, update, amendment or deletion in appropriate circumstances. Some of these rights may be subject to some exceptions or limitations. We will respond to your request to exercise these rights within a reasonable time (and in all cases within 30 days of receiving a request).
Rights which you are entitled to are:
- Data access rights
- Right to restrict processing
- Right of Rectification
- Right to Erasure (Right to be Forgotten)
- Right to object to processing
- Right to withdraw consent; and
- Data portability rights
